The carer must be resident and provide care for at least 35 hours per week, if an employed carer then they cannot earn more than £44.00 per week and must work at least 24 hours per week. The person receiving the care must be in receipt of (or entitled to) one of the following state benefits:
A person cannot be disregarded as a carer if they are the partner, spouse or civil partner of the person in receipt of care.
A person cannot be disregarded as a carer if they are the parent of the person in receipt of care and that person is under the age of 18 years.
