Procedure for Dealing with Bonfire Nuisance
Initial Enquiry
General advice will be given to both the enquirer and the occupier of the premises from where the smoke was originating. No further action will be taken at this stage unless a further complaint is made.
Complaint
- The complainant should carefully consider whether the bonfires are causing a nuisance and if so to contact the Environmental Protection Section at the Council. Both parties will be written to explaining that the complaint has been received and the matter is now under investigation. The complainant will be given a monitoring form to record the dates and times when bonfires are carried out and what the effect was.
- After receiving the monitoring information the complainee will be contacted by letter explaining that events have been recorded and monitoring will be carried out by the investigating officer to determine the existence of a statutory nuisance.
- If after 3 observations statutory nuisance is not established then both parties will be contacted and informed that the investigation has been completed and no action is to be taken.
If a statutory nuisance is observed then an Abatement Notice will be served on the person responsible for the fires. The Notice will require the person to control bonfires in such a way so as not to cause a statutory nuisance.
If smoke still continues then evidence will be collected and prosecution action will be pursued.
- If at any stage the complainant considers that the bonfires are no longer causing a serious problem then both parties will be sent a completion letter and no further action will be taken unless a further complaint is received.
NB.Details of the complainant’s name and address will not be passed onto the complainee unless the complainant gives permission.
