Procedure For Dealing With Domestic Noise Nuisance
- Complaint is received and recorded in Planning and Environment Department
- The Officer will visit (or otherwise contact) the complainant and the alleged offender within 2 working days, offer advice, explain the noise investigation procedure and that monitoring of the problem maybe carried out if noise continues. Letters will be sent to each party, the complainant will also be sent an observation sheet.
- After 3 weeks an officer will visit, write to, or otherwise contact the complainant to request the observation sheet be returned so that the information on the observation sheet can be assessed in order to decide whether the problem is continuing or has been resolved.
If the problem persists the officer will write to the alleged offender advising that the Council’s investigation of the matter is continuing.
- Up to 3 observations will be carried out from the complainants premises either by attendance of an officer or by using a Digital Audio Tape (DAT) recorder system.
- If a noise nuisance is confirmed the officer will serve a noise abatement notice on the alleged offender and legal proceedings may follow if the terms of the notice are not complied with.
- If after 3 observations it is not possible to confirm that a nuisance exists or if the officer decides that the noise complained about does not constitute a nuisance, the complainant will be advised that no further action will be taken by the Council. The investigating officer will offer advice to the complainant particularly in respect of the action which can be taken by an individual.
N.B. If for any reason, it is found to be impossible or not appropriate to adhere to the various stages of the above procedure, the officer will notify the circumstances to the complainant.
The above procedure only applies to domestic noise complaints it does not apply to house intruder alarms or car alarms.
The same procedure will be used for owner-occupied properties, local authority properties and private rented properties
