Local Searches and Local Land Charges

Gedling Borough Council maintains a Register of Local Land Charges which contains information which may affect properties such as Tree Preservation Orders, Listed Buildings, other planning matters and financial charges.

Purchasers of a property in the Borough will carry out a search of the Register, usually through their solicitor, to reveal any entries that there may be against the property. The Council also responds to "Standard Enquiries of Local Authority".

Gedling Borough Council strongly recommends that if you are buying, selling or remortgaging a property you request that your solicitor or estate agent orders a local search directly from the Council. This will ensure receiving:-

Please note:  

On 1 August 2007, the new CON29 (2007 Edition) was introduced. The new CON29 comprises Required and Optional parts (CON29R and CON29O). Each part is a stand alone product that can be ordered separately. Clients who wish to discover all relevant information may still submit both parts, though they do not have to be submitted at the same time.

Gedling Borough Council is now only able to accept the new CON29R and CON29O forms.

What is the cost of a standard search?

The cost of a standard Local Authority Search and "Required" Enquiries is £115.00.

(The cost of the CON29R Enquiries is £109.00 and a Requisition for Local Search is £6.00.)

The Council is currently at Level 2 for searches submitted electronically through the NLIS hub. The standard NLIS search fee is £98.00.

What is the cost of a personal search?

The cost of a personal search is £11.00.

What is the cost of any additional enquiries?

Any additional enquiries are £12.50 per enquiry.

Adjoining parcel of land on same Search - extra £15.50 per parcel (Requisition for Search and Enquiries).

Printed (CON29O) enquiries are £9.50 per enquiry, except number 22 which is £14.00.

How long does it take to get a search completed?

Usually five to six working days, but no longer than ten working days.

Are you on the DX?

No.

Do I need to send a plan with my search?

Yes please, this enables us to accurately identify the property.

There is some uncertainty about the boundary line between my property and next door. Will the Local Search clarify this?

No. A Local Search is completed against the plan submitted.

Should I do a Mining Search?

Yes, the whole of Gedling Borough is a former coal mining area.

Can I pay extra for an Expedited Search?

No, searches are dealt with strictly in date order.

Can the Local Land Charges Office tell me who owns a property?

No, ownership of property is dealt with by Nottingham District Land Registry (Telephone 0115 9351166).

The postal address of the property does not state Gedling but it is believed to be in Gedling Borough. Can this be correct?

Yes. "Gedling Borough" is a local government authority area that includes Gedling but also comprises the following: Arnold, Carlton, Daybrook (part), Redhill, Mapperley (part), Netherfield, Colwick (part), Burton Joyce, Calverton, Woodborough, Linby, Papplewick, Stoke Bardolph, Bestwood Village, Newstead Village, Newstead Abbey Park, and Ravenshead.

Why do I need to have a Local Search done?

If you are applying for a mortgage, the building society will insist on a Search. It is also a requirement for inclusion in Home Information Packs. In any case, the Search protects you, for example by telling you whether a new road is going to be built near your property and many other matters that may affect the property. The Council is insured in case anyone suffers loss because of a mistake on our part.
