The Licensing Act 2003 requires local authorities to produce and review a licensing policy for their area, reflecting the transfer of the liquor licensing responsibility from the Magistrates’ Courts to local authority control. The Licensing Act amalgamates liquor licensing with other licensing activities presently performed by local authorities including public entertainments, theatres, cinemas and late night refreshment house premises. Many hot food businesses such as late night takeaways and mobile food vendors operating after 11.00PM will require licensing for the first time. The Licensing Policy Statement can be reviewed at any time as necessary but local authorities must ensure that their Licensing Policy Statement is reviewed at least every three years.
Within Nottinghamshire the eight local authorities having responsibilities under the Licensing Act have worked very closely together to review their licensing policy statements. Each local authority has taken the common document for customisation prior to embarking on a period of consultation as required by the legislation. The aim of the policy is to secure the safety and amenity of residential communities whilst facilitating a sustainable entertainment and cultural industry in the area. The policy commits this Authority to partnership working with the local police; fire service; local businesses; the licensing trade; residents and others to meet the four licensing objectives:
The legal nature of the document reflects the future function of the policy as the basis for determining applications, which are subject to appeal to the Magistrates’ Court.
Every three years all local authorities are required to review their policy document relating to the Licensing Act which controls the issue of licenses for the sale of alcohol, late night refreshment and some entertainments. This review includes consultation with organisations in the trade, responsible authorities under the legislation (such as the Police) and to residents in the area.
The document reflects both the legislation and national guidance relating to licensing and sets out the policies that will be followed by this Council when deciding on licensing applications. The draft Licensing Policy is currently open for consultation (consultation runs for twelve weeks from the 5th July to 24th September 2110 and a copy of the draft policy is available from Customer Services or can be downloaded from here. Comments can either be emailed to licensing@gedling.gov.uk, or posted to the Licensing Office, Gedling Borough Council, Arnot Hill Park, Arnold, Notts NG5 6LU.
All comments made on the draft document during the consultation period will be collated and placed on this page. All comments received will be considered and the necessary amendments made to the document before presenting the final policy to a full Council meeting later this year. The new Policy will come into effect on the 7th January 2011.
This Authority completed its statutory period of consultation on the 15th of November 2007 and the document showing the comments received and the changes made to the Statement may be obtained here.
