What is a Local Plan?

The Gedling Replacement Local Plan (external link) was prepared by Gedling Borough Council as the local planning authority and adopted on 12th July 2005.  The Local Plan identifies particular areas as suitable for housing, industry, retail and other uses.  The Local Plan also sets out the policies which the Council proposes to apply in deciding whether or not development will be permitted.

Saved/Deleted Policies

As a result of the Planning and Compulsory Purchase Act 2004, policies in the adopted Gedling Borough Replacement Local Plan were due to ‘be deleted’ on 12th July 2008, being 3 years after the date of adoption of the Plan.  In order for the Borough Council to retain policies beyond this date, agreement needed to be sought from the Secretary of State to issue a direction to ‘save’ them.  The Borough Council submitted a list of policies, and their intentions for them, to Government Offices in January 2008.

Councils are expected to give reasons for whether or not each policy should be ‘saved’.  The Department of Community and Local Government takes eleven issues into account in deciding whether to agree to ‘save’ policies, but primarily the issue is whether the policies “are necessary and do not merely repeat national or regional policy”.  Policies should also not conflict with national or regional policy unless there is special justification.

On 9th July 2008, the Secretary of State’s Direction was received, which stated that all of the policies proposed by the Council to be saved should indeed be saved.  Those policies not proposed to be saved were therefore deleted on 11th July 2008.  The schedule of saved policies and the covering letter from Government Office can be accessed by the following links:

In due course, the saved policies will be replaced by new policies in Development Plan Documents prepared under the Local Development Framework.  These will include the Core Strategy, Site Specific Allocations and the Generic Development Control Policies documents.

Tell me more about the Written Statement and the Proposals Map

The Replacement Local Plan comprises a Written Statement and a Proposals Map.

The Written Statement contains the background and reasoning for the policies and/or proposals and is available with the Proposals Map from the following link.

The Proposals Map shows the Borough and which parts of the Borough are affected by specific policies and/or proposals.

Paper copies can be viewed at the Civic Centre or in any local library in the Borough.  The Plan can also be purchased for £20-00 plus £3.91p postage by arrangement with the Planning Policy Team in Strategy and Performance Services at the Civic Centre or by e-mailing planningpolicy@gedling.gov.uk .

The Inspector’s Report into the Local Plan Inquiry was received (on 12th March & 19th May 2004) and may be downloaded. In addition, the document may be viewed at local libraries or hard copies obtained from the Borough Council offices at the Civic Centre in Arnold, £15.00 per copy (£20.00 including p & p).

The Council considered the Inspector's recommendations and its response to them. A Statement of Decisions and Proposed Modifications was prepared which set out the Council's response to each of the Inspector's Recommendations and whether the recommendation was accepted by the Council. The document also sets out all the Proposed Modifications to the Revised Deposit Local Plan and the reasons for them.

A number of Technical Papers have been prepared and can be downloaded which provide background information to various aspects of the Local Plan. Technical Paper 3 has been revised in order to address the Environmental Appraisal of the Proposed Modifications to the Revised Deposit Local Plan.
