Final Decision Statement

The Burton Joyce Neighbourhood Plan was officially made (adopted) by Gedling Borough Council on 10 January 2019. As such the Burton Joyce Neighbourhood Plan now forms part of the Development Plan for Gedling Borough. In accordance with Regulations 19 and 20 of the Neighbourhood Planning (General) Regulations 2012 the following documents are made available:

Referendum

The Burton Joyce Neighbourhood Plan was approved by referendum on 29th November 2018. The declaration of result can be viewed here.

Decision Statement

Following the independent examination of the Burton Joyce Neighbourhood Plan and the receipt of the Examiner's Report, Gedling Borough Council decided on 24th October 2018 that it agrees with the Examiner's recommended modifications and that the amended Burton Joyce Neighbourhood Plan should proceed to referendum. The Decision Statement (with Final Plan attached) can be viewed here and is also available for inspection at:

Examiner's Report

The independent examiner released his report on the Burton Joyce Neighbourhood Plan 2017-2028 on 16th October 2018. The report recommends a series of modifications and minor corrections to the neighbourhood plan. The examiner's report can be viewed here.

In accordance with government regulations, Gedling Borough Council must now issue its 'decision statement' on the examiner's report within five weeks.

Independent examination of the Burton Joyce Neighbourhood Development Plan

The comments received through the consultation along with the Submission Neighbourhood Plan and supporting documents will be passed to an independent Examiner, Christopher Collison BA (Hons) MBA MRTPI MIED MCMI IHBC. The Examiner will consider the representations, whether the plan meets the basic conditions and other relevant legal requirements, and will determine if the plan should be put to a community referendum. The Examiner may request further information to help in his consideration and may conduct the examination through written representations only, or he may call a public hearing to examine a particular issue in more depth.

The Examiner has to decide whether or not the plan meets the "basic conditions" and make a report that either:

  • the plan is submitted to referendum,
  • modifications specified in the report are made and the plan as modified is submitted to referendum, or
  • the plan is rejected
Consultation on Submission Plan (Regulation 16 Stage)

Gedling Borough Council was required to consult on the Submission Plan for a six week period after which comments received are forwarded to an independent Examiner for their consideration. The consultation tok place from Friday 27th July 2018 until Friday 14th September 2018. The formal consultation notice (Regulation 16 Notification) can be viewed here.

Submission of plan proposal (Regulation 15 Stage)

Burton Joyce Parish Council submitted the Burton Joyce Neighbourhood Plan to Gedling Borough Council on 20th June 2018. The following documents were submitted to the Council and are available to view by clicking here.

Strategic Environmental Assessment (SEA) Screening

Gedling Borough Council (on behalf of Burton Joyce Parish Council) has prepared an SEA Screening Report for the Burton Joyce Neighbourhood Development Plan (Draft Plan November 2017). It has been determined that the Plan is not likely to have significant environmental effects and a full SEA is not required in respect of the Plan. The requirement to prepare an environmental report, in accordance with the Environmental Assessment of Plans and Programmes Regulations 2004, has been met. An addendum to the SEA/HRA Screening was published on 24 September reflecting concerns raised by the examiner in his initial letter dated 23 August 2018. Consultation on Draft Plan (Regulation 14 stage)

Burton Joyce Parish Council held a consultation on the Pre-Submission Draft Burton Joyce Neighbourhood Plan which closed on 14th March 2018. Comments received have been considered by the Parish Council.

Application to designate a Neighbourhood Area

A formal application was received from Burton Joyce Parish Council requesting that they be recognised as a Neighbourhood Area for the purpose of producing a neighbourhood plan, in accordance with the Neighbourhood Planning (General) Regulations 2012.

Gedling Borough Council publicised this application to produce a neighbourhood plan for a 6 week period during February/April 2016. In response to the application submitted by the Parish Council, the Council has acknowledged that a neighbourhood plan area that reflects the Parish boundary would be a logical and appropriate area for the preparation of a neighbourhood plan. As such, Gedling Borough Council designated the Parish of Burton Joyce as a neighbourhood area (as requested by the Parish Council) on 25 April 2016. The name of the neighbourhood area is the 'Burton Joyce Neighbourhood Area'.

You can view the designated Burton Joyce neighbourhood plan area. The designated map shows the area for which Burton Joyce Parish Council intend to prepare a neighbourhood plan, which is the entire Parish of Burton Joyce.
